In child custody matters, Texas courts are required to use the "best interests of the child" standard. It is presumed that it is in a child's best interest to maintain meaningful contact with each parent. Therefore, Texas courts will presume that each parent should have joint custody, or will serve as "Joint Managing Conservators" of their children. As a result, in most cases, parents will share in making decisions about the child's health, education, religious upbringing and general welfare. Joint custody does not mean that each parent will have equal parenting time. In most cases, one parent will have primary custody and the other parent will have visitation.
