Texas is a community property state, which means that nonmilitary spouses may be entitled to as much as half of a servicemember's retirement benefits. This can be a bitter pill to swallow for members of the armed forces who have lived in a noncommunity property state for most of their time in the military.
Another major issue involves child custody and child support. For instance, everything on a servicemember's Leave and Earnings Statement (LES), such as the Basic Allowance for Housing (BAH), can be included when calculating child support, even though these benefits are tax free.
